Berkeley Systems Inc. v. Delrina
Berkeley Systems challenged Delrina's Death Toasters screensaver module, alleging copyright and trademark infringement based on its resemblance to the Flying Toasters imagery associated with After Dark. A preliminary injunction halted sales and led to a recall. The court rejected Delrina's argument that the commercial software received the same parody protection as literary or cartoon works. Delrina later removed the wings from the toasters and renamed the module Censored Toaster Module.
