New York appellate court affirms summary judgment for Edward A. Kurmel Brokerage in policyholder coverage-gap suit

A New York appellate court (Appellate Division, Second Department) unanimously affirmed summary judgment in favor of insurance brokerage Edward A. Kurmel Brokerage, Ltd., dismissing a policyholder's negligence and breach of contract claims alleging the broker failed to ensure adequate coverage after his circumstances changed; the court held that absent a specific request for additional coverage or a special relationship, a broker has no continuing duty to advise, guide, or direct a client to obtain additional coverage. The client's brother's appeal was dismissed separately for lack of standing.
