Chrisanna Elser files proposed class action against Flock Group over license plate reader use in false package-theft accusation

    Lawsuit filed

Colorado resident Chrisanna Elser filed a proposed class action in the U.S. District Court in Denver against Flock Group, the towns of Columbine Valley and Bow Mar, Sergeant Jamie Milliman, and Chief Bret Cottrell. She alleges she was wrongly issued a criminal summons for a $25 package theft based on a Flock automated license plate reader hit. The claims against Flock include intrusion upon seclusion, negligence, and negligent design, on the theory that Flock sold a searchable plate archive without requiring a warrant. She seeks deletion of retained location data and warrant requirements before agency searches.

Stated objective. Have Columbine Valley, Bow Mar, Cottrell, and Flock delete the retained location data, bar retention unless tied to an open case number, and require Flock to mandate a warrant, a case number, and supervisor approval before a Colorado agency can search the system.

    Company response

    • Denial — Flock

Flock stands by the accuracy and integrity of its technology and intends to vigorously defend itself in this litigation
