Texas sues Gerber and Nestle USA over toxic heavy metals in baby food

    Lawsuit filed

Texas Attorney General Ken Paxton filed a lawsuit against baby food maker Gerber and its parent company Nestle USA, announced Wednesday, alleging the companies misled parents about the safety of baby food containing arsenic, lead and other toxic heavy metals and made false and misleading claims about its purity and safety. The action was brought under the Texas Deceptive Trade Practices Act, and the state alleges internal testing revealed elevated concentrations of toxic substances in certain ingredients. The allegations have not been adjudicated, and the announcement does not establish that Gerber or Nestle violated consumer protection laws.

Stated objective. Hold the company accountable to ensure the promises made to parents about what they feed their babies are kept.

    Company response

    • Denial — Gerber

Gerber has disputed the allegations, stating that their products meet the Food and Drug Administration's (FDA) limits for heavy metals.
