Egyptian Subsidiary Found to Receive “Cross-Border Subsidy” and Hit with Countervailing Duty; Court Challenge Fails

The EU launched a countervailing investigation into glass fiber fabrics originating in Egypt, found that China Jushi’s Egyptian subsidiary received subsidies including preferential financing from Chinese state-owned banks in the China-Egypt Suez Economic and Trade Cooperation Zone, attributed them to the Egyptian government, and imposed a countervailing duty of about 10.9%. Jushi Egypt challenged the decision before the EU General Court, and the case was dismissed in 2023. It set a precedent for the EU’s finding of “cross-border subsidies,” affecting Chinese companies’ overseas layout.
