Progressive sues to avoid covering trucking crash claim
Progressive Express Insurance Company filed a declaratory judgment complaint on August 13, 2026 in federal court in Houston, asking a judge to rule it owes nothing on a claim tied to a September 15, 2023 highway crash in Harris County, Texas. Progressive argues the tractor-trailer involved was not listed on the policy, the driver was not a rated driver, and MMT Carriers was not the motor carrier involved, so the MCS-90 endorsement does not apply.
