Overview

DILIA (full name: DILIA, divadelní, literární, audiovizuální agentura, z.s.) is a Czech association of authors and other copyright holders, based in Prague. Its principal activity is the protection of copyright. The organization is structured into two main divisions: an agency division that negotiates individual licences and contracts, and a collective rights management division that administers rights primarily in the fields of literature and audiovisual works. DILIA operates four agency departments — Theatre, Music, Literature and Media — each serving authors, rights holders and users of protected works. The Theatre Department provides information on contractual conditions for staging protected works by Czech and foreign authors. Its services are used not only by professional theatres and theatrical agencies but also by amateur ensembles and arts schools. It handles licences for protected works, exclusively administers licences from agencies associated with CISAC, and covers domestic and foreign theatre festivals, tours of Czech theatres abroad, and guest performances of foreign companies in the Czech Republic. It also offers new, adapted or successful titles for dramaturgical plans and arranges translations of foreign plays. The Music Department publishes and rents musical materials, especially for musical-dramatic works. It provides these for live performance, radio or television broadcast, sound or audiovisual recording, and related uses. It also represents and mediates musical materials of foreign partners and other domestic rights holders. The Literature Department secures rights for book use of works in fiction, scholarly and educational literature, children's literature and book illustration. It represents Czech authors, including translators, or their heirs for book or magazine use in the Czech Republic and abroad. The Media Department provides services concerning copyright primarily in the audiovisual field, but also addresses the use of all works through media — television, internet and radio broadcasting. It licenses uses in advertising, releases on physical media (CD, DVD, Blu-ray) and audiobooks. It assists users such as film producers, television and radio stations, and advertising agencies in finding rights holders and mediates licences. DILIA also has a Legal Department, which in the 1980s handled inheritance agendas for publishers and contractual matters. The organization has supported young artists since 2005 through projects such as the Evald Schorm Award, DILIA Theatre Grants, DILIA Translation Workshop, 3D, and 8V8 — a cycle of stage sketches. DILIA is a member of CISAC and operates as a non-profit association (z.s.).

History

DILIA is a Czech artistic agency focused on copyright protection, operating mainly in the fields of theatre, literature, music and media. Internally, this artistic association is divided into an agency and a collective rights management division. The agency division handles individual negotiation of terms, conclusion of contracts, cases of unauthorized use of works, collection and payment of licence fees. It operates through four agency departments: Theatre, Music, Literature and Media. The Theatre Department provides information on contractual conditions for staging protected works by Czech and foreign authors. Its services are used by professional theatres, theatrical agencies, amateur ensembles and arts schools. It handles licences for protected works, exclusively administers licences from agencies associated with CISAC, and covers domestic and foreign theatre festivals, tours of Czech theatres abroad, and guest performances of foreign companies in the Czech Republic. It also determines conditions based on dramaturgical plans and provides information about authors and their works. The department offers new, adapted or successful titles for dramaturgical plans and arranges translations of foreign plays. It seeks news from domestic and foreign theatrical production, using sources such as the Synopses section, and distributes texts of represented authors, available for sale or loan. The Music Department publishes and rents musical materials, especially for musical-dramatic works. It provides these for live performance, radio or television broadcast, sound or audiovisual recording, and related uses. It also informs about musical materials and rental conditions, concludes rental and use contracts, and provides services to users and rights holders in the field of broadcasting and recording of musical-dramatic works. For works that are staged (where copyright protection subsists in any component), special authorization is required, which is contractually mediated by the Theatre Department. The department also represents and mediates musical materials of foreign partners and other domestic owners. It assists users such as film producers, television and radio stations, and advertising agencies in finding rights holders and mediates licences for works to be broadcast, placed on the internet or otherwise used. It represents authors, heirs and other rights holders in concluding licence and work contracts, helps with negotiating terms and provides legal protection. The Legal Department in the 1980s had two staff lawyers, one head and one administrative worker, located in a Baroque house in the garden of the main building at Vyšehradská 28. It handled a large inheritance agenda, especially for publishers of artistic publications, tracing heirs of artists when data was missing. It also handled normal contractual agenda passed from other departments. The department successfully resisted a Ministry of Finance request to pay fees of emigrant authors whose property had been confiscated by court decision, arguing that DILIA was only an administrator of money not belonging to it; the fees remained on the account and were paid after 1990 to entitled persons upon their return from emigration. A fire complicated the work, as inheritance files stored in the "márnice" had to be reconstructed; in the first half of 1987, 300 card index sheets were restored. Collective rights management is another subsystem of DILIA, focusing primarily on literature and audiovisual works. Since 2005, DILIA has supported young artists through projects such as the Evald Schorm Award, DILIA Theatre Grants, DILIA Translation Workshop, 3D, and 8V8 — a cycle of stage sketches.
