Overview
The Haftpflichtgemeinschaft Deutscher Nahverkehrs- und Versorgungsunternehmen (HDN) is a German self-insurance and loss-sharing association for municipal transport and utility companies. It is a nichtrechtsfähiger Verein — a non-legal-capacity association — whose members are municipalities, municipal associations, their own operations, and transport and utility companies in which municipalities or other public bodies hold at least 50 percent. Rather than buying commercial insurance, members join HDN to equalise expenses arising from liability, motor vehicle, and passenger accident losses. As a self-insurance institution, HDN is exempt from insurance supervision under § 1 Abs. 3 Nr. 3 of the German Insurance Supervision Act (VAG), and its members are exempt from compulsory motor liability insurance under § 2 Abs. 1 Nr. 5 of the Pflichtversicherungsgesetz, being treated as so-called self-insurers under § 2 Abs. 2 of that law. HDN traces its origins to 1903, when the "Haftpflichtgemeinschaft Deutscher Straßen- und Kleinbahnen" was founded in Berlin. After the Second World War, the Notgemeinschaft Essen was established in 1945 as part of the association; in 1966 it was renamed "Haftpflichtgemeinschaft Deutscher Nahverkehrsbetriebe (HDN)". The Berlin association was dissolved in 1974, and in 1986 the organisation took its current name, "Haftpflichtgemeinschaft Deutscher Nahverkehrs- und Versorgungsunternehmen (HDN)". A Berlin office began operating in 1994. In 1995 the affiliated "Haftpflichtgemeinschaft Deutscher Nahverkehrs- und Versorgungsunternehmen Allgemein (HDNA) VVaG" was founded to insure privatised transport and utility companies, and in 1997 the Versicherungs-Vermittlungsdienst Essen GmbH (VVE), now VVE Versicherungs-Service GmbH, was created to round out the service offering. The head office moved from Essen to Bochum in 2002. HDN's cover includes general liability insurance, motor vehicle liability and other vehicle liability insurance, sea, inland waterway and river shipping liability insurance, motor vehicle comprehensive insurance, and passenger accident insurance. Unlike commercial insurers, HDN does not work with pre-calculated premiums but operates on a levy (Umlage) basis: because it does not seek profit, only the expenses actually incurred in a financial year are apportioned among members after the year ends. The association currently has around 440 members, including the largest German municipal transport operators such as those in Berlin, Hamburg, Essen, Düsseldorf, Leipzig, Dresden, Cologne, Munich, Bremen, Hanover, and Frankfurt am Main. Its largest member group is DB Regio Bus, which bundles more than 40 bus companies and participations of Deutsche Bahn AG. Management has been in the hands of Aline Thomas since 1 July 2017. Through a function-outsourcing agreement, HDN also performs the organisational tasks of HDNA VVaG.
History
The Haftpflichtgemeinschaft Deutscher Nahverkehrs- und Versorgungsunternehmen (HDN) is a German self-insurance and loss-sharing association for municipal transport and utility companies. It is a nichtrechtsfähiger Verein — a non-legal-capacity association — whose members are municipalities, municipal associations, their own operations, and transport and utility companies in which municipalities, municipal associations, or other public bodies hold at least 50 percent. It serves its members by equalising expenses from liability, motor vehicle, and passenger accident losses, and thus represents an alternative to commercial insurance. As a self-insurance institution, HDN is exempt from insurance supervision under § 1 Abs. 3 Nr. 3 of the German Insurance Supervision Act (VAG). Its members are exempt from compulsory motor liability insurance under § 2 Abs. 1 Nr. 5 of the Pflichtversicherungsgesetz and are regarded as so-called self-insurers under § 2 Abs. 2 of that law. The organisation's history begins in 1903 with the founding of the "Haftpflichtgemeinschaft Deutscher Straßen- und Kleinbahnen" in Berlin. In 1945 the Notgemeinschaft Essen was established as a component of the Haftpflichtgemeinschaft. In 1966 the Notgemeinschaft Essen was renamed "Haftpflichtgemeinschaft Deutscher Nahverkehrsbetriebe (HDN)". The Berlin Haftpflichtgemeinschaft was dissolved in 1974. In 1986 the organisation was renamed "Haftpflichtgemeinschaft Deutscher Nahverkehrs- und Versorgungsunternehmen (HDN)". In 1994 the Berlin office began operations. In 1995 the "Haftpflichtgemeinschaft Deutscher Nahverkehrs- und Versorgungsunternehmen Allgemein (HDNA) VVaG" was founded to insure privatised transport and utility companies. In 1997 the Versicherungs-Vermittlungsdienst Essen GmbH (VVE), now renamed VVE Versicherungs-Service GmbH, was founded to complete the service offering. In 2002 the head office moved from Essen to Bochum. In 2017 the chief managing director and his deputy were dismissed; an investigation report mentioned, among other things, "excessive travel costs, privileged sales of technical equipment and vehicles [and] use of the office's resources for a personal legal practice". HDN's business activity is loss equalisation for its members, offering cover in the following insurance branches: general liability insurance, motor vehicle liability insurance and other vehicle liability insurance, sea, inland waterway and river shipping liability insurance, motor vehicle comprehensive insurance, and passenger accident insurance. Unlike the commercial insurance industry, HDN does not work with pre-calculated premiums but operates on a levy (Umlage) procedure. Because it has no profit-making intent, only the expenses actually incurred are apportioned to members after the end of a financial year. The association currently has around 440 members, including the largest German municipal transport companies such as the transport operators in Berlin, Hamburg, Essen, Düsseldorf, Leipzig, Dresden, Cologne, Munich, Bremen, Hanover, and Frankfurt am Main. The largest member group is DB Regio Bus, which bundles more than 40 bus companies and participations of Deutsche Bahn AG. Management has been in the hands of Aline Thomas since 1 July 2017. Through a function-outsourcing agreement, HDN also performs the organisational tasks of HDNA VVaG.
